Planning Appeals Frequently Asked Questions
We answer the most common questions about planning appeals and our fixed price planning appeal statements
Planning Appeal Statements provides fixed fee planning appeal statements for householders, developers and small businesses seeking to maximise their chances of obtaining planning permission on appeal without the expense of a full planning consultancy service. With our service you submit the appeal yourself, using the planning appeal statement prepared by us and, if required, attend the appeal site visit. This enables us to provide you with professional written representation for your planning appeal at very competitive rates. On this page, we answer common questions about planning appeal procedures and our service. Contact us without obligation if you require further information or advice, or just to talk things through.
What is a written representations appeal?
An appeal dealt with by an exchange of written statements and a site visit.
What is a householder appeal?
Householder appeals use a simplified version of the written representations procedure, which takes 8 weeks instead of 16 weeks.
What are the other appeal methods?
Appeals can also be heard in front of an Inspector at a Hearing or Inquiry. If we consider that your case should be dealt with by one of these methods, we will advise you accordingly.
Do you offer no-win no-fee appeals?
No, because we would have to raise our fees to cover the cost of defending unsuccessful appeals.
Do you carry out a site visit?
No, this is one of the ways we keep our fees low. We review all the relevant plans and documentation. Where relevant, we ask you to supply photographs. This provides sufficient information for us to prepare your case.
How do I submit the appeal?
You submit a simple form with a copy of your planning application and the local authority's decision notice. Your grounds of appeal are set out in the planning appeal statement provided by us.
What is the appeal site visit?
The appeal site visit is only to allow the Inspector access to the site. No discussion about the appeal is allowed. You do not need to be professionally represented at the appeal site visit.
What if I need help?
We provide unlimited telephone and email support for the duration of your appeal.
Can I make an application for costs?
Yes, in certain circumstances. We can advise you about this on request.
Can I see a sample appeal statement?
Yes, you can download an example of our planning appeal statements here.
